Payment and Quote Terms
White Water Electrical Company may provide the customer with a quote, which is valid for 30 days from the date of issue unless otherwise agreed in writing. Each quote includes an automated fee, which may be waived at the company's discretion if the customer proceeds with the quoted work. All quotes are based on material costs at the time of preparation and if supplied by the client, the client will provide all necessary materials and instructions in a timely manner. Specifications and descriptions within the quote are intended as a general representation of the product or service.
White Water Electrical reserves the right to make adjustments that do not alter the intended purpose. White water electrical is not obligated to commence work until the quote is formally accepted by the customer. Furthermore, white water electrical reserves the right to revise any quote before completion of the order to reflect changes in costs, and the customer will be notified of any amendments, at which point the revised quote will serve as the current estimate.
Damage to property
In the event that any property belonging to the customer is damaged due to the negligence of White Water Electrical while performing work in accordance with the agreed terms, White water electrical will be responsible for rectifying the loss or damage. However, White Water Electrical will not be liable for any loss or damage that arises from the customer’s own negligence or failure to take reasonable steps to prevent or minimise the risk of such damage.
Warranty
White Water Electrical provides the NSW HBA Standard of warranty.
(Under the Home Building Act 1989, statutory warranties for residential building work apply (2 years for normal defects, 6 years for major defects)
Product warranties are provided by the manufacturers in accordance with their own terms and conditions. In cases where an electrical issue arises with a product supplied by White Water Electrical, the business will cover the labour costs associated with addressing the issue. Light globes and tubes are covered by a limited warranty period of 6 months. All warranty claims are valid only once the invoice for the related work or products has been paid in full.
Title
All products supplied by White Water Electrical remain the property of the business until full payment is received for all outstanding amounts, including any related transactions. If payment is not made within 14 days of supply, White Water Electrical reserves the right to repossess the products. Extended payment terms may be granted at White water electricals discretion. The customer authorizes White Water Electrical to enter their premises to recover any unpaid products within the agreed timeframe. The customer indemnifies White Water electrical against any property damage or personal injury resulting from such entry. If the contract is terminated after work has commenced, all products used remain the property of White Water Electrical Company until the related invoice is paid in full.
Termination
In addition to any other rights of termination outlined in these Terms of Trade, the customer may terminate the agreement by providing 30 days’ written notice to White Water Electrical. Should the customer terminate the agreement, they are required to pay for all work completed by White water electrical up to that point. White Water Electrical reserves the right to terminate the work and agreement at any time.
Variations
The customer may request a variation to the quote by notifying White Water Electrical either verbally or in writing. If the customer alters their requirements after a quote has been issued or an order placed, the business reserves the right to adjust the quote to include any additional charges for extra costs incurred or additional work required, in line with current charge rates. Any revised quote issued will supersede the original. White water electrical is entitled to an automatic extension of time to deliver goods or services equal to the delay caused by the variation. Diagnostic fees will apply for any additional work requested by the customer. Call-out fees do not apply while White water electrical is already on site; however, call-out fees may vary based on the customer’s location, particularly for areas outside of Sydney.
Disputes
In the event that a dispute arises between White Water Electrical and the customer regarding the agreement, both parties agree to engage in good faith negotiations to resolve the matter before escalating the issue to the Department of Fair Trading or initiating any legal action.
Limitation of Liability
To the fullest extent permitted by law, White Water Electrical excludes liability for any breach of terms implied by law under these Terms of Trade. All information, specifications, and samples provided by White water electrical relating to goods or services are approximate only. Subject to any guarantees under the Australian Consumer Law, minor deviations or variations that do not substantially affect the customer’s use of the products or services will not entitle the customer to reject the goods or services or make a claim. Any advice, recommendations, information, assistance, or services provided by White Water Electrical are given in good faith and believed to be accurate and reliable at the time but are provided without warranty as to their accuracy or appropriateness. White water electrical accepts no liability for any loss incurred as a result of the customer’s reliance on such advice or information. Furthermore, White Water Electrical is not liable for any delays in the commencement of work.
Returns and Refunds
White Water Electrical handles returns and processes refunds in compliance with Australian Consumer Protection legislation. If you wish to return any uninstalled products, please notify us within 7 days of purchase, providing a valid reason for the return. Should we be unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the returned goods. Only unopened products with packaging in good condition are eligible for a full refund. Refunds will be processed promptly and issued using the original payment method. All refunds are at the discretion of White Water Electrical.
Invoicing and Payment
White Water Electrical may issue invoices at its sole discretion in one or more of the following ways: prior to commencing work, for an amount equal to the quote plus any additional charges if no prior work has been done for the customer; or weekly before order completion, invoicing a portion or the full quoted amount. The invoice amount reflects the quote and any additional charges. Customers must pay valid tax invoices within 14 days of issue. If any invoice remains unpaid, White Water Electrical may withhold further work until outstanding amounts are settled. Customers are not entitled to withhold payment due to any alleged fault or delay by the company, though this does not affect rights under the Australian Consumer Law. All costs associated with collecting overdue payments, including legal fees and internal expenses, are payable by the customer. For contracts exceeding $20,000, customers have a 5-business-day cooling-off period to cancel the contract. If work has commenced, any cancellation requires payment for all completed work, materials, and labour to date. If White Water Electrical attends the site to assess and the customer chooses not to proceed, the call-out and diagnostic fees still apply. Any after-hours service work requires a credit card security deposit; the customer will not be charged until job completion, but if White water electrical has already travelled to the site and the job is cancelled, the call-out fee will be charged.
Indemnity
The customer indemnifies White Water Electrical against any third-party claims for indirect or consequential loss or damage, regardless of cause, including negligent acts or omissions by the company. This includes, but is not limited to, loss of data, revenue, profit, or other indirect costs. Additionally, the customer indemnifies White Water Electrical against any liability to any person for loss or damage, whether direct or indirect, caused or contributed to by the customer.
Deposit
A deposit may be requested from the customer for work valued at $1,000 or more, particularly when non-standard materials need to be purchased to complete the requested work. Deposit payment is required prior to commencement of the work, based on the invoice date.
Quality of Work
All work carried out by White Water Electrical will comply with applicable New South Wales and Australian laws to the extent required. Additionally, all work will adhere to the conditions of any relevant development consent or development certificate, where applicable. It is the customer’s responsibility to provide White Water Electrical with a copy of any such conditions or certificates prior to the commencement of works. The business ensures that all materials used are as supplied by the manufacturer and include the manufacturer’s warranty, with warranty duration dependent on the specific material. White Water Electrical does not accept responsibility for any damage or loss resulting from a defective part.
Access
The customer must provide reasonable access to the site to enable White Water Electrical to carry out the required work. If White water electrical arrives on-site and access is unavailable, additional charges may apply. The customer is also responsible for removing any items from the area where work is to be performed, upon request by White Water Electrical.
Clean Up
Once work has been finalised, White water electrical must remove all rubbish and material relating to the work. All leftover material is the property of the Company, unless otherwise agreed upon between the Company and the Customer.
Governing Law
All services being provided shall be governed and construed in accordance with the Law of NSW and the Commonwealth of Australia.
Certificates
At the customer’s request, White Water Electrical will issue a compliance certificate only after full payment for the completed work has been received.
License
White Water Electrical must hold a valid electrical license, excluding apprentices, trade assistants, or work experience students working under appropriate supervision. Customers may request to view the contractor’s license at any time.
